An immigration bail bond is a form of federal bond that is issued to an individual who is arrested for being in the US illegally. The detention and arrest are usually made by agents from Immigration and Customs Enforcements (ICE). Once a person is issued an immigration bond, he or she is free. However, they must attend a future court hearing to address the immigration violation and any possible sentence.
Similar to a standard bail bond, an immigration bail bond requires a defendant to pay a specific amount of bail as a fee to a bail bond agency. If the defendant fails to attend court hearings, the total amount of the bond becomes due immediately. Once the defendant attends the court hearing, his or her bond is terminated regardless of the outcome of the hearing.
Basically, two types of immigration bail bonds are issued to an illegal immigrant in custody. They are:
Delivery bond: A delivery bond is issued to an illegal immigrant having a standing order to appear in court within a short time. The purpose of this type of bond is to ensure that the individual shows up at every hearing. This bond allows the arrested individual to spend time with their family and consult with an immigration lawyer.
Voluntary bond: This type of bond is issued so the immigrant gets the opportunity to leave the country within a certain period of time by paying a specific amount of money.
An immigration bond can be paid in two ways. They are:
Surety bond: Friends or family members of an arrested individual can work with an immigration bond agent to get a surety bond. A bail agent will typically charge 15 to 20% of the total bond amount. The money or collateral is non-refundable.
Cash bond: With this type of bond, friends and family members of the arrested individual can pay the full amount of the bond directly to ICE. The amount will be refunded once the person appears in all the court hearings. A cash bond can be made by cash, cashier’s check, money order or US bonds or notes.
