Bail bond forfeiture arises when a defendant fails to appear in court. The judge will order a bond forfeiture hearing to determine if the defendant had a good reason for failing to appear in court. If it is determined by the judge that the defendant did not have cause, the judge will issue a warrant for the defendant’s arrest by a certain date. If the defendant is unable to be located before the date, the court proceeds with bond forfeiture. A forfeited bond cannot be refunded, it becomes the property of the jurisdiction overseeing the case.
